1. Agreement

These Terms of Service ("Terms") form a binding agreement between you and Nawah ("we", "our", or "the Service") governing your access to and use of the Nawah mobile application and related services. By creating an account, ticking the agreement checkbox at registration, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old, or the minimum age of digital consent in your country, to create an account. If you are a minor, you may only use the Service under the supervision of a parent or legal guardian who agrees to these Terms on your behalf. You must provide accurate registration information and keep it up to date. You are responsible for safeguarding your password and for all activity that occurs under your account.

3. Description of the Service

Nawah is a family-organization app. After creating an account, you can create or join one or more "families" — private groups of users who share content with one another. Inside a family you can: • send chat messages, photos, videos, voice notes, reactions, and polls inside chat; • create and assign tasks, calendar events, shared lists, polls, and announcements; • upload files (photos, PDFs, videos, notes) to a shared family vault; • share your live location on a family map — in the foreground and, if you grant "Always" permission, also in the background while sharing is enabled; • mute individual chats and delete your own messages; • set a custom wallpaper for each chat; • ask the AI Assistant for planning help. Content you create inside a family is visible to every current member of that family. Treat anything you post in a family as shared with the whole family.

4. Acceptable Use and Objectionable Content

Zero tolerance for objectionable content and abusive behavior. When you accepted these Terms at registration you agreed to the rules in this section. Violations may result in immediate content removal and account termination without prior notice. You agree not to use the Service to post, upload, share, or transmit any content that: • is unlawful, fraudulent, defamatory, threatening, or violates the rights of others; • is sexually explicit, pornographic, or sexualizes minors in any way; • depicts or promotes graphic violence, self-harm, suicide, or cruelty; • harasses, bullies, intimidates, or stalks any person, including other family members; • incites or promotes hatred, discrimination, or violence on the basis of race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, or age; • contains malware, spyware, viruses, or any code designed to disrupt or harm the Service; • infringes any patent, trademark, trade secret, copyright, or other intellectual property right; • misrepresents your identity or impersonates another person; • involves spam, unsolicited commercial messages, pyramid schemes, or chain letters; • violates any applicable law or regulation. You also agree not to: • attempt to gain unauthorized access to any account, family, or part of the Service; • scrape, copy, or reverse-engineer the Service except as expressly permitted by law; • interfere with the operation of the Service, including by overloading our infrastructure or our service providers; • use the Service to abuse, threaten, or harass our staff, moderators, or service providers.

5. Reporting, Blocking, and Moderation

Every chat message has a long-press menu with Report and Block user actions. You can review and unblock blocked users at any time from Settings → Blocked Users. Reports are routed to our moderation team and reviewed promptly. We may, at our sole discretion and without prior notice: • remove or hide content that we believe violates these Terms; • suspend or permanently terminate the account of any user who violates these Terms; • cooperate with law-enforcement authorities where required by law. We are not obligated to monitor all content, but we reserve the right to do so. We are not responsible for content you encounter that is created by other users.

6. Your Content

You retain ownership of the content you submit to Nawah ("Your Content"). By submitting Your Content you grant us a worldwide, non-exclusive, royalty-free licence to host, store, transmit, display, and make technical modifications (such as thumbnailing, format conversion, and caching) of Your Content solely as needed to operate, maintain, secure, and improve the Service. This licence ends when you remove Your Content, except that backups and copies retained as part of family history (see Privacy Policy section 9) may persist. You represent and warrant that you own Your Content or have all rights necessary to share it on the Service, and that Your Content does not violate these Terms or any applicable law.

7. Family Membership and Roles

The user who creates a family is its creator and is responsible for managing membership, including inviting members and removing them when appropriate. Joining a family requires a join code shared by the family creator. Family creators can rotate or disable the join code at any time from Manage Family. If you are removed from a family, you immediately lose access to that family's content. Content you contributed remains visible to the family. Family creators must transfer or delete their families before deleting their account.

8. AI Assistant

The AI Assistant uses Google Gemini to generate suggestions and help draft tasks, events, and lists. You acknowledge that: • responses are generated by AI and may be inaccurate, incomplete, or out of date — you should verify important details; • the AI does not make changes to your data without your explicit confirmation; • prompts you submit are sent to Google for processing as described in the Privacy Policy; • the AI may also receive limited account context (your name, role, active family) and family content your prompt requires (events, tasks, lists, announcements, locations) so it can answer accurately — see Privacy Policy section 5.2 for details. Do not rely on the AI Assistant for medical, legal, financial, or other professional advice.

9. Account Termination

You may delete your account at any time from More → Settings → Danger Zone → Delete Account. The effects of deletion are described in the Privacy Policy. We may suspend or terminate your access to the Service, with or without notice, if we believe that you have violated these Terms, that your use of the Service poses a risk to other users or to our infrastructure, or that we are required to do so by law.

10. Fees

The Service is currently provided free of charge. If we introduce paid features, we will give you advance notice and an opportunity to review the applicable pricing and terms before any charge is incurred.

11. Intellectual Property

The Service, including its software, design, text, graphics, logos, and trademarks (other than Your Content), is owned by Nawah or its licensors and is protected by copyright, trademark, and other intellectual-property laws. We grant you a personal, non-transferable, revocable licence to use the Service in accordance with these Terms.

12. Third-Party Services

The Service relies on third-party providers (including Google Firebase, Google Maps, Google Gemini, and Cloudflare R2) listed in the Privacy Policy. Your use of those providers' services through Nawah is also subject to their terms. We are not responsible for the practices of third-party providers.

13. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant that any defects will be corrected or that the Service will meet your requirements. The family map is a convenience feature, not a safety or emergency-tracking system. Background location may be delayed, paused, or stopped by the operating system, device battery optimization, lack of signal, or other factors outside our control. Do not rely on Nawah's location features to ensure anyone's safety. Nawah is not a substitute for emergency services. Do not rely on the Service to communicate emergencies. If you are in danger, contact local emergency services directly.

14. Limitation of Liability

To the maximum extent permitted by law, neither Nawah nor its officers, employees, agents, or service providers shall be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Service. Our total aggregate liability for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid us, if any, in the twelve (12) months preceding the claim, or (b) US$50. Nothing in this section limits any liability that cannot be limited under the applicable consumer-protection law of your country of residence.

15. Indemnification

You agree to indemnify and hold harmless Nawah and its officers, employees, agents, and service providers from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in connection with (a) Your Content, (b) your use of the Service, or (c) your violation of these Terms or any applicable law.

16. Governing Law

These Terms are governed by the laws of the Kingdom of Saudi Arabia, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the competent courts of Riyadh, Saudi Arabia, and you consent to the personal jurisdiction of those courts. Nothing in this section limits any non-waivable rights you may have under the consumer-protection law of your country of residence.

17. Changes to These Terms

We may update these Terms from time to time. When we make material changes we will update the "Last updated" date above and, where appropriate, notify you in the app. Continued use of the Service after a change constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and may delete your account.
